General Terms and Conditions Hand und Fuss by Max Binder (GTC)

Hand und Fuss by Max Binder offers services (individual consultation & support & treatment) in the areas of movement and body therapy. A detailed description can be found in the list of offers.
Unless otherwise agreed, the service can only be used by the customer personally.
Where these GTC or the individual contractual agreement do not contain any provisions, the statutory rules on the normal service contract §§ 611 ff. BGB apply.
These GTC can be changed by Hand und Fuss by Max Binder at any time without prior notice. Any changes will be communicated to the customer in writing.

Personal training sessions and Rolfing sessions are offered. The duration of a personal training session is 60 minutes. The duration of a Rolfing session is 60-75 minutes. Shorter or longer training/treatment sessions are expressly agreed upon.
The type, scope, and location of each service unit are agreed upon with the customer. Content and goals are determined in advance in a personal consultation.
Before starting the first service, a mandatory health check/anamnesis will be conducted by Hand und Fuss by Max Binder.
Hand und Fuss by Max Binder is also available to its customers outside of training sessions from Monday to Friday between 7:00 am and 8:00 pm within the scope of the agreed service via telephone and email. There is no entitlement to constant availability of Hand und Fuss by Max Binder.

Registrations are binding as soon as they have been confirmed by both parties. This applies to all communication channels used, such as telephone, email, or WhatsApp, orally or in writing.
With the appointment agreement or the conclusion of a subscription and the associated knowledge of the GTC, a contract between the customer and Hand und Fuss by Max Binder is concluded. By concluding the contract, the customer expressly agrees to these GTC.

The current prices can be found in the valid price list. These are available at any time on the website www.handfuss.com. Price changes are reserved and will be communicated to existing customers in writing or in person.
Any other costs incurred by providing the service (rental costs for premises, admission fees, venue rentals, etc.) are to be borne by the customer or will be invoiced to the customer.
The total amount for a subscription must be fully transferred within 14 days after the invoice date. Exceptions must be discussed directly with Hand und Fuss by Max Binder.
The customer will receive a written invoice from Hand und Fuss by Max Binder with a detailed breakdown of the services provided.
If Hand und Fuss by Max Binder purchases products (sports articles, etc.) on behalf of the customer, the goods remain the property of Hand und Fuss by Max Binder until full payment by the customer.

In case of prevention, the customer has the possibility to cancel free of charge up to 24 hours before the service is provided. Otherwise, the agreed fee for the booked service will be charged to the customer in full. In case of illness, the customer is exempt from the obligation to pay by presenting a medical certificate.
If the execution of a personal training session is considered too dangerous, impossible, or similar due to unforeseeable circumstances (weather conditions, etc.), the service unit may take place indoors or be postponed after consultation. The decision on execution will be made jointly with the customer for personal training sessions no later than 2 hours before the start of training.
In exceptional cases (illness, vacation, etc.), a similarly qualified trainer may take over the provision of the service after prior consultation with the customer.

It is the task of Hand und Fuss by Max Binder to ensure the proper implementation of the agreed service. Furthermore, it is the customer's own responsibility to achieve their training goal.
The customer is responsible for insuring themselves against accidents and injuries that may occur within the scope of the agreed service. The same applies to the direct journey to and from the location where the service is provided.
No claims for compensation can be made in the event of a short-term cancellation of training by Hand und Fuss by Max Binder. Services already paid for will be credited or refunded upon request.

The customer's personal data is stored by Hand und Fuss by Max Binder and used exclusively for the purpose of fulfilling the contract.
Hand und Fuss by Max Binder is obliged to maintain confidentiality about all information about the customer that becomes known in connection with the provision of the service, even beyond the termination of the service.
The stored data will be deleted upon request, but no later than 12 months after the last booked service. In all other respects, the statutory data protection regulations apply.

Changes, additions, side agreements and individual agreements require written form to be effective.
If any of the preceding provisions are invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a suitable replacement provision shall be agreed upon that achieves the economic success as closely as possible.
The place of jurisdiction is D-Lörrach. German law applies.
